刘强东被捕时涉嫌一级强奸重罪! 美警方披露当晚执法报告, 更多细节曝光

昨天以来，有关“刘强东在美涉嫌性侵”事件（戳回顾），又陆续传出了重磅消息——涉嫌一级强奸重罪！

《纽约时报》：警方透露，京东董事局主席兼CEO刘强东因强奸指控被捕

早前，警方的声明中使用了“犯罪性行为” (criminal sexual conduct) 一词，没有提供更多细节。（注：“犯罪性行为”指一系列非自愿的性接触。）

据明尼阿波利斯警方最新公布的报告显示，刘强东于8月31日晚以涉嫌强暴的一级重罪遭逮捕。如被正式定罪，将面临最高30年的监禁。

Chinese billionaire Richard Liu Qiangdong was arrested on a rape accusation, a first-degree felony if the founder of e-commerce giant JD.com is charged with the crime, according to police records.

No charge has been filed against Liu as the matter is still under investigation by the sex crimes division of the Minneapolis Police Department. If charged and convicted, Liu could face a prison sentence of up to 30 years.

而这份警方最新公布的逮捕刘强东当晚的记录显示，刘强东（45岁）是以“强暴”(rape)重罪(felony)遭逮捕。从警方据报到场到完成报告，当地负责该案的警察都挂着随身摄影机全程纪录。

报告中提到，警察接到性犯罪强暴(Criminal Sexual Conduct Rape，CSCR)的举报到场，受害人报案完成后，警方发给了她报案的蓝卡(blue card)，同时也拍下现场及受害人照片，嫌犯被逮捕后，转送到亨内平郡(Hennepin County)监狱关押，此案进行调查时，警察随身摄影机全程开启。

涉嫌的罪行描述为：一级性犯罪，强奸既遂 (CSCR-1,CSC-RAPE-COMPLETE），罪行等级为一级重罪。警方在报告中是以「609.342」的罪名控罪刘强东，根据明尼苏达州的法律，609.342为性犯罪五级中的一级重罪。

美国明尼苏达州泓发律师事务所律师周东发对澎湃新闻记者分析，在明尼苏达州，一级性犯罪最少要判144个月（12年），初犯可能被判罚的刑期是144个月到172个月。

虽然没有透露更多详细信息，但明尼阿波利斯警察局发言人埃尔德称，这起事件发生在当地时间周五凌晨1点，刘强东于当晚被捕。

It gave no further details, but Minneapolis Police Department spokesman John Elder said the alleged attack reportedly occurred at 1 a.m. local time on Friday, and that Liu was taken into custody later that evening.

《华尔街日报》援引一位与受害者熟悉的人士的说法称，刘强东以涉嫌强奸被捕，是在一个团体晚宴之后。自称遭性侵的女士是一位明尼苏达大学的中国学生。8月30日晚，美国明尼苏达州明尼阿波利斯市，一家名叫折纸（Origami）的日本餐厅里，举行了一场有红酒和日料的团体饭局，自称遭性侵的女士与刘强东坐在同一桌。

The arrest of Chinese billionaire Liu Qiangdong last week in the U.S. on suspicion of rape followed a group dinner attended by Mr. Liu and the woman who alleges the assault, according to a person familiar with the woman’s account.

Mr. Liu and the woman, a Chinese student attending the University of Minnesota, sat at the same table Thursday at Origami, a Japanese restaurant in Minneapolis, the person said.

据当时在现场的人说，当晚有大约20多人一起在饭店里吃饭喝酒，他们自带了一部分红酒，还在店内的食物、服务和其他酒水上花费了1900美元。当天在现场的人不知道这群人之中是否有刘强东。其中一人称，这群人中有一个人，穿着套衫，被其他人称为“老大”（boss）。还有一个人提到，饭局约在晚上9点结束，有几个人喝到头都趴在了桌子上。

A group of about 20 people drank and dined at the restaurant Thursday night, say people who were present. The people couldn’t say whether Mr. Liu was among them.

The group brought their own bottles of wine and also spent about $1,900 on food, sake and other drinks, according to one of the people. One male attendee, dressed in sweat clothes, was called “boss” by several members of the group. Before the evening gathering ended, at about 9p.m., several men put their heads down on the table, one of the people said.

受刘强东性侵风波影响，9月4日，该事件后美国股市的第一个交易日，京东股价下跌约6%。9月5日，京东股价收盘更是下跌超过10%。两个交易日市值已经蒸发72亿美元。

而9月5日，Rosen、Schall、Pomerantz三家美国律师事务所分别在官网宣布，将调查京东是否失实披露刘强东案情，导致投资者蒙受损失，并且邀请损失超过10万美元的股民参与调查和可能的集体诉讼。

The investigation focuses on whether the Company issued false and/or misleading statements and/or failed to disclose information pertinent to investors. JD.com Chairman and CEO Qiangdong Liu was arrested in Minnesota on charges of sexual misconduct on August 31, 2018. Based on this news, JD.com’s share price fell by almost 6% on September 4, 2018.

美明尼苏达州亨内平郡监狱记录显示，当地时间8月31日23：32，一名叫"Liu Qiang Dong"的男性因涉嫌刑事性行为在明尼阿波利斯市被捕，并于9月1日16：05获释，没有缴纳保释金。

Jail records from Hennepin County, Minneapolis show a man named Liu Qiangdong, born on March 10,1973, was arrested in Minneapolis, Minnesota, on suspicion of criminal sexual conduct. Liu was arrested at 11:32 pm on Aug 31, and released pending investigation at 4pm Sept 1, according to jail records.

9月2日，京东在微博发布声明称，“刘强东先生在美国商务活动期间，遭遇到了失实指控”。

JD.com said Liu was on a business trip in the United States when he was questioned about an “unsubstantiated accusation,” according to a statement posted Sunday to the Chinese social network Weibo. “ The local police quickly determined there was no substance to the claim against Mr. Liu, and he was subsequently able to resume his business activities as originally planned,” according to the statement.

刘强东在明尼苏达州的律师格雷周一表示，刘强东否认有任何不当行为。格雷表示，相信刘强东不会受到起诉。

Earl Gray, a Minnesota-based lawyer for Liu, said on Monday that the Chinese businessman has denied any wrongdoing and that he did not expect his client to be charged.

明尼阿波利斯警察局发言人埃尔德周二表示，刘强东涉性侵案最早要到本周末才会有最新消息，目前尚不能确定其是否会被起诉。

Minneapolis Police Department spokesman John Elder said on Tuesday that if there were any charges against Liu they would not be filed until completion of a criminal investigation that would not occur before Friday.

9月4日上午，刘强东性侵风波回国后首度现身京东集团总部。受此轮风波影响，京东股价创出19个月最低。

Liu returned to JD.com’s headquarters in Beijing on Tuesday morning, after being released from a county holding cell in Minneapolis, Minnesota. JD.com’s shares plunged to a 19-month low in US trading on Tuesday as investors weighed the possible impact of the investigation.

据澎湃新闻报道，从字面上看，此案目前的状态是：释放等待控告（released pending complaint），有点类似于国内的“取保候审”。

根据美国相关法律，保释与限制出境之间没有直接必然联系，也就是说对于被保释的当事人，并不必然需要限制其出境；反之，如果当事人可以自由出入美国国境，也不能代表其保释措施已经被警方撤销。同时，被拘捕或者被保释本身，并不代表当事人就已经被认定为有罪，警方的角色和定位仅仅是搜集证据、还原犯罪现场，当事人是否有罪要由法庭来裁决。

明尼阿波利斯市亨平县检察官办公室发言人Chuck Laszewski回复澎湃新闻记者称，一旦此案被明尼纳波利斯市警察局提交，亨内平县检察官办公室就会开始调查，“现在我们还没有收到此案的档案。警方仍在调查。一旦此案被提交给我们，我们会有3个选择：我们可以决定不起诉任何罪行；可以决定提出指控；或者我们也可以把它发回警方要求进一步的调查，这种情况通常会附上一系列我们做决定之前需要解答的问题。”
